To Probate…or Not to Probate.

Let’s start with a simple dictionary definition of probate.  It is defined as “the official proving or validity of a will”.  As Baby Boomers age, more and more questions about this legal procedure are being asked.  How long does it take?  Is it necessary in my particular situation?  Do I need legal assistance to sort it out?

If you have heard that it is horribly expensive and as complicated as learning Mandarin Chinese you have probably been needlessly scared.  On many occasions the answer is simple…you and your family do not need probate.  Even if you do, it probably entails one 10-minute appearance before a judge then filing a simple motion which closes the estate.
